Dear Ramesan, thank you very much for sharing with us. I would like to inquire whether, even after the court order, the inspectors and other relevant department officers are adhering strictly to the same policies. Additionally, Mr. Ramesan, could you clarify whether the principal employer is required to cover the entire contribution in job work scenarios? It has been suggested that if we engage in any job-related activities with a third party, such as job work or labor contracts, the principal employer must bear the full ESI contribution as per their billing. Despite providing all necessary details, they seem unwilling to investigate the matter with the other party.
I have been informed by my legal advisor that there have been two orders from Karnataka and one from the Supreme Court regarding this issue. Do you have any information about these cases?

There are a few documents I can share with you in the coming days. In job-related cases, if you collect their ESI code number or if they are in an exempted area, the principal employer is not liable for contribution. I will come back to you with more details soon.
