Dear seniors, I have one confusion regarding registration under the Factory Act. I have a factory registered under the Factory Act. Now, I have started a new factory with the same name under Unit II, and the number of employees is 8. Now, I am confused about whether I have to apply under the Factory Act for the same. Please help me.

The information provided by you is not adequate. Is this Unit II in the same place or in a different place? What type of factory is it? How many are in Unit I? First of all, why do you call your unit a factory? This itself needs to be clarified.

These clarifications would help us provide you with a better opinion on your query.

Please refer to the attachment for some of your queries. Nevertheless, it is very important to check the requirements with the concerned officials designated under the Factories Act of your state and the Labour Department. Ensure you satisfy yourself about the requirements beforehand rather than repenting later. Develop a habit of possessing and referring to all relevant law books as frequently as possible to have a clear idea of what you should and shouldn't do. Half-knowledge gained from various sources is not foolproof and can be dangerous. Officials should guide you in their capacity to prevent landing in trouble later. Eliminate presumptions and assumptions to avoid complications. While we can provide some suggestions based on the details you provide in the forum, it may not be sufficient to guide you thoroughly.

With regards,
Kumar S.

No registration is required under the Factories Act as the minimum threshold is 10 to make it a factory. However, if the second unit is also in the same premises, then you will have to apply for an amendment to the original license.
