If an employer pays PF of employees which were in arrears for a year in two installments (due to heavy pressure from the PF officers) but finds that the employer does not require to pay for employees who were drawing more than Rs 10,000. Originally speaking, the employer was cheated by the PF officers who knew that the manager who looks after the firm had no knowledge in PF.
Now, after paying the PF, but came to know about the PF ceiling, the employer wants to fight the case stating to reimburse the PF he has accidentally paid. Does he have the provision to claim back? The PF officer only has the wage register where we have only filled the BASIC Wages column, which amounts to Rs 6,000 for most employees but has not filled any column, even the DA. However, the gross salary exceeds Rs 11,000, which was also paid through the Bank, providing solid proof through the bank statement.
Please tell us if we have a good case, as the PF people have clearly cheated the employee by concealing the rule about PF ceiling.
