Dear all,

Is it possible for a company to deposit the PF-ESIC contributions under the coverage code of another company? Yesterday, I came to know that a company has more than 20 employees, but to fulfill the statutory liabilities, the company is depositing both contributions under the other company's code. They are even issuing ESIC cards to the employees.

Regarding the query from the customer (principal employer), they submit the challan of PF-ESIC with the bill. Please mark "with the company name mentioned on the challan."

Please help me with this concern. I would be very thankful to you.

Company should have a separate code for its individual company. When it comes to balance sheets, they are individual. If a contractor does not have an ESIC/PF Code, then it is the liability of the principal employer to deposit the same in their code.

Dear Vikas,

Here are two things we have to consider:

01. In the case of a company that qualifies under either a factory or shops/establishment, it is supposed to comply under its own ESI code number.
02. In the case of contractors, if they supply manpower/render services to any other unit that has an individual ESI code number, and if the contractor does not qualify individually for ESI, the compliance of all their employees should be made under the Principal Employer, i.e., where such workers work.
