Dear All,

I want to know if there is any rule that an employee who has not completed his probation and resigns is not eligible for an experience letter. As per my understanding, an experience letter should be given. Please correct me if I am mistaken.

I think an experience letter should not be issued to employees who resign before the completion of the probation period or who are in the probation period. Companies have their own rules regarding this. However, the reason behind not issuing the letter is that it can be misused as his/her name gets associated with the company and is not even six months. So the company is not liable to issue since the person is still in the training period. Secondly, when a person wants to resign before the completion of the probation period, then the employee has already breached the contract. One cannot ask for an experience letter if he/she has worked for one day or week; it's up to the company to decide if he/she is within the probation period.

The employee is eligible for an experience letter if he/she fulfills all terms and conditions of the appointment letter related to the notice period, termination, or leaving the job. Please provide all details for the best possible solution. In case of ambiguity, please feel free to contact.

Thank you for your valuable comments. I totally agree with you, but the suggestion from Kapil Dev Singh ji is more suitable in my case. I apologize for not providing all the details. The case is that the employee has almost completed the probation period. Two days before completing his probation, he submitted his resignation because he has to go abroad. I was asked why I had to give him an experience letter. My concern is that he is almost done with his probation and he could have also resigned after confirmation as he still had one month to go. Despite this, I provided him with the experience letter.

I just want to know if I was wrong or right in my decision?
