Dear Friends,
Though the Gratuity Act states that 5 years of service are required for eligibility for gratuity, I was informed that there is a High Court/Supreme Court judgment which mentions that 4 years and 10 months of service is sufficient to make a claim. Can anyone provide the details of this judgment?

Hi Neha,
Post 60 days of your last working day with the organization, you need to submit the PF & Pension withdrawal forms (available with organizations or in PF department Bandra) to the PF department. Usually, companies depute consultants for coordinating with the PF department. Thus, these consultants are responsible for filling up the accurate details needed in the form, also stating the final amount to be received by you via PF & Pension funds, respectively. They are also responsible for completing the forms in all respects with signatures from you & the organization. However, if your company does not have any such provision, your Accounts department would have all the details. Please get in touch with them.
