Concerns with Security Guard Board Services

There is a significant issue with the industrial sector, including companies like Tata Infomedia, BASF, Galaxy Surfactants, Inox India Pvt. Ltd, and Nocil, regarding the guard board services they offer not being up to the mark. Additionally, there is a union likely to form in your company, which complicates matters further. Even if you wish to terminate the guard board service, you may face challenges due to the Security Guard Board (SGB), as they can create legal problems for the company and upcoming security agencies. The rates charged by SGB are considered too high by top-notch security service agencies, and they do not match the quality of services provided. Payments must be cleared by the 7th of every month, or a penalty of 10% will be incurred. Moreover, there are numerous clauses, making it preferable to hire a private agency.

In my opinion, it is advisable to hire a private agency. Pay them well, but also ensure they comply by duly paying E.S.I.C., P.F., and service tax. Private agencies are not permanent, so if you need to replace them, it's quite easy, unlike with SGB.

I have mentioned earlier, too, that the Security Guards Board Act of 1983 is a state act, and the regulations are the same for the entire Maharashtra. There is no variance district-wise as far as rules and the act are concerned. However, there can be differences in the minimum wages prescribed by each district board.

Every employer agency shall comply with the provisions of the Minimum Wages Act, 1948 (XI of 1948); the Payment of Wages Act, 1936 (IV of 1936); the Payment of Gratuity Act, 1972 (XXXIX of 1972); the Employee’s Provident Fund and Miscellaneous Provisions Act, 1952 (XIX of 1952); and the Contract Labour (Regulation and Abolition) Act, 1970 (XXXVII of 1970); or any other Act as may be applicable to them, for the time being. Therefore, registers relevant to all the above acts, plus the ones prescribed by the guard board, may be maintained.
