We are having a security agency in which there are fourteen guards and two supervisors. The problem is that the agency does not provide payments or any other benefits to its employees; hence, the guards are not performing their duties properly. Our management has decided to discontinue the agency and hire the same guards under our company's payroll.

There is a big no-no from the industrial sector such as Tata Infomedia, BASF, Galaxy, Surfactants, Inox India Pvt. Ltd, and Nocil regarding guard board services offered by them not being up to the mark. Secondly, there is a union bound to happen in your company, and then there is somewhat forceful service that even if you want to terminate the guard board service, you won't be able to due to the security guard board herein referred to as SGB, because of the legal problems they create for the company as well as for upcoming security agencies. The rates are too high as per top-notch security service agencies, and the rates do not match the services provided by SGB. The payment has to be cleared by the 7th of every month, or a penalty of 10% will be incurred. Moreover, there are a lot of clauses; hence, it's better to hire a private agency.
Therefore, in my opinion, it is advisable to hire a private agency, pay them well, but also ensure that they comply by duly paying E.S.I.C., P.F., and service tax. Private agencies are not permanent, so in case you need to replace them, it's quite easy, which is not the same as with SGB.

I have mentioned earlier, too, that the Security Guards Board Act of 1983 is a state act, and the regulations are the same for the entire Maharashtra. There is no variance district-wise as far as rules and the act are concerned. However, there can be differences in the minimum wages prescribed by each district board.
