I want some help from all of you. Presently, I am working in a Pvt. Ltd. Company. I joined on 05.01.2009 and receive my salary through the bank. Recently, the company issued Form-16 to all my colleagues from whose salary they deducted tax. When I asked for Form-16, they mentioned that they did not deduct any tax from my salary, so they will not issue Form-16 to me. However, my previous employer issued Form-16 regularly even when they did not deduct any tax from my salary. They simply took details and supporting documents of my investments during the financial year and issued Form-16 accordingly. I file my IT return based on that Form-16.

My question is, is it mandatory for an employer to issue Form-16 for each employee? Can employees take any action against an employer who refuses to issue Form-16 for the salary paid by them? I need my Form-16 to file my IT return.
