Dear,

According to the Factory Act, these are the types of leaves:

Leaves are of different types:

NFH (National Festival Holiday)

CL (Casual Leave): 7

SL (Sick Leave): 7

All three types of leave come under the Industrial Establishment (National Festival Holidays, Casual Leave, and Sick Leave) Act 1965 and are defined for every state. Please check this Act, otherwise, you may need to contact the Labour Department for clarification.

EL (Earned Leave): 14

Earned leave is defined through The Factory Act, 1948, Section 79. Eligibility for EL is a minimum of 240 days worked in the previous year. One day is earned for every 20 days worked for adult workers and one day for every 15 days worked for child workers.

Calculation:

Total Days in a year = 365 Days

Total absences in a Year = Sundays + NFH + CL + SL

Total Present = Total Days in a Year - Total Absences

Total EL = Total Present / 20 (For Adults)

Total EL = Total Present / 15 (For Children)

Maternity Leave:

Women employees are eligible for Maternity leave upon completion of a minimum of 80 days of service at the Organization, as defined in The Maternity Benefit Act, 1961. This facility will be available for the birth of the first two children only.

Maternity leave would be granted for a maximum of 90 days, including all the weekly offs and holidays falling in between.
