I am Ravi Kumar, working as the Manager of HR. I have a query regarding Leave Encashment. Are consultants eligible for Leave Encashment in my organization? There are three types of consultants in our organization: 1. Full-Time, 2. Retained Consultants, and 3. On-Call Basis.

We provide leave benefits to full-time consultants, and my question is whether consultants are eligible for leave encashment. Please advise.

If consultants are on your payroll as salaried officers, they are eligible for leave encashment. If they are not on the payroll, then they shall not be considered your employees and, as such, will not be eligible for leave or leave encashment.

Dear Ravikumar, Only your payroll employees are eligible for leave encashment. Consultants are not eligible for leave encashment. Regards, Bem

Hi,

In the case of my organization, the consultant enjoys privileged leave amounting to 21 days per year. This is calculated on a pro-rata basis. Will he be entitled to encashment of any PL balance to his credit once he resigns?
