I resigned from my job in 2004 at a Delhi-based company where I worked in the Tirupur branch. They kept my name in one concern for 3 years and then transferred it to their sister concern for another 2.5 years. In both companies, I was in the PF role. Now, they are denying my eligibility for gratuity. Can anyone help me with how I can go about claiming it? Am I eligible for it or not?

Hi Ilango,

Please let me know the following details:
- Date of joining in the first concern
- Date of transfer to the second concern
- Date of resignation from the second concern
- Is a transfer order provided when you are transferred from the first concern to the second concern?
- Is your PF account number the same in both concerns? If not, is the PF amount transferred from the first concern to the second concern?
- Do both concerns belong to the same employer?

If you provide the above details, it will be easy for me to advise you on this matter.

Hi Elango,

Have you received your relieving order/Experience Certificate? If so, what is the Date of Joining they have provided? If they have indicated your first Date of Joining (DOJ), you will be eligible for gratuity. However, if they have provided the Date of Joining after the transfer, it may not be possible.

Dear Mr. Venkatesh,

I joined on 19 March 1998 and was relieved on 30 April 2004. They never gave me any transfer letter or even an appointment letter. This information was accepted by the employer. They sent a letter directly to the PF office for my PF claim, which I also sent directly to the PF office.

Hi, My name is Vikas.

I joined a company in the year 2004 and was transferred to a sister concern company after 2 years. I left the company in 2010 after completing 6 and 1/2 years in both companies. I have the appointment letter and transfer letter from the first company to the second company. Am I eligible to receive gratuity based on my entire tenure with the companies?
