There are 100-120 employees in our company. I would like to know if the Attendance Register is compulsory for a Software Company. Do labor offices accept electronic attendance data? What do companies with 500-1000 or more employees do about their daily attendance?

Hi, The company’s have to maintain a attendance register, or they can opt for a electroninc data machine that will do.

Yes, they will accept electronic data, but you need to get an exemption under the Act from the respective authority. Once you receive the exemption, there is no need to maintain an attendance register.

Dear Anu,

Firstly, attendance registers must be maintained everywhere. It is not an issue whether it is a software company or a local shop.

The labor office accepts electronic register data, but the condition is that it must be approved by the relevant authority.

Dear Anuradha,

Most of the software industry is now implementing flexible working hours. Maintaining the attendance register is simply to keep a record for the payroll. As others have mentioned, we can proceed with electronic data once we receive an exemption from the Labor Department.

Dear Anuradha,

The law is the same for all companies. Whether we have to maintain manual records or if we want to maintain electronic records for attendance, leave, and salary, we have to seek an exception from the authorities. For factories, it would be the factory inspector, and for shops and establishments, it would be the labor department.

Kindly inform me how to get the exemption for electronic data. The labor officer advised me to get an exemption and write a letter to the concerned persons regarding this. So, I want to know the procedure or to whom I should apply?

Where are you located? If in mumbai, Bombay Shops & Est Act will be applicable to you. In that case, you will have to apply for exemption from maintaining manual records.
