Dear All Can Any Body Suggest Me How To Calculate Earn Leave :- 1) Is It On Basic Salary Or Gross Salary? 2) We Give 15 El In A Calender Year If It Is Praportional ,how We Can Calculate In An Employee Is Absent For 60 Days . 3) Where There Is No Salary Structure But El Has Given In Advance The Gross Salary Is Effected.whereas We Give Encashment It Will Be Paid Less Amount Than In Advance. I would like to add one thing to the reply of Mr. PBS Kumar that the employee who was present for 240 days in last calander year is only eligible for EL. For the purpose of calculation of present days Weekly offs, National & Festival Holidays and leaves has to be considered. Narendra

Dear Narendra ji,Your ans is true that taking into cosideration of EL calculation 240 days is mandatory, but as per sec.79, Explanation-2 of the Factories Act stating that "The leave admissible under this sub-section shall be exclusive of all Holidays whether occuring during or at either end of the period of leave".Regarding other leaves means CL / SLs generally not to clubed with the ELs.(PLEASE REFER THE BOOK OF HL.
