The above discussion is very interesting and prompt answer.
I would like to tell, to avoid these kind of problems, before engaging a contractor in a company the principle employer should ensure that the contractor is having registration under PF, ESI, License, PAN No. Bank accounts, TIN No. etc.
This will avoid all legal conflicts.

sir, thanks for the replay..
In this case the contractor himself is working with other contract workers. He do not have any other contracts. As a principl employer is it required to inform the details of this contract to the authorities ?

Hello,
I wish to tell you before engaging a contractor you have to ensure all the things.
Now if you are having contractor who is not having License and also less than 20 workers, kindly remove him and appoint a new contractor having all legal registrations.
This is good for you as a pricnciple employer.
This is some what difficult but you have to follow if you do not want to enter into any legal problem.

Dear sir, undeer the FACTORIES ACT ONLY can register under the ESI ACT SUBJECT TO 10 EMPLOYEES, other than this, 20 employees should be there along with some conditions.or EPF., 20 EMPLOYEES should be there.
*conditions in ESI ACT. 1. CONTRACT LABOUR SHOULD BE REGISTERED UNDER THE CONTRACT LABOUR ACT & GET LABOUR LICENCE. 2. 3 OR 4 WORKS ORDERS TO BE ATTACHED.3. 3 TO 4 MONTHS BANK STATEMENT TO BE ENCLOSED.4. PAY ORDER TO BE DRAWN FOR 6 MONTHS

Need Expert Suggestion,
We have received notiec under Kerala S&E Act. However, we dont have the onroll employee over there. Only Employee is working which is offroll. We have obtained the Shop RC for this branch. However, Authority has asked to present the all the registers as per the Kerala shop act rules.
Contractor is saying that they are following central rules and obtained the single Shop RC centrally at Pune, Maharashtra. They are providing registers under Contract Labour Act.
Please suggest, do we ask to contractor to maintain the registers as per Kerala state rules under Shop Act?

I am a contractor working in a mnc company. I have only 4 employees. But the mnc company is asking for PF code. They said me to give a proof about why I cannot open PF code. They need a report or a letter to submit in their documents for a reason for not opening PF code.

i joined the Ministry in 2008 as a contract basis, if first time contractor provide a 7 employees in the Ministry as a contract basis, after 2-3 year, increase the employees strength on 25-30, but they not provide ESI, EPF, no leave and no bonus, 2008 i have take 7200 salary and after 2014 i have take 10000 salary, also in mentioned terms and condition with the Ministry, contractor provide a minimum wages, esi, etc....... but they have not provide any facilitate, also contractor not registered with the Labour & Employment CLRA, Act then contractor change 2014, new contractor provide everything, so who will be responsible for all the above said facts.
