Dear Vikas,

As per PF Act

Employee Definition:

"Employee" as defined in Section 2(f) of the Act means any person who is employee for wages in any kind of work manual or otherwise, in or in connection with the work of an establishment and who gets wages directly or indirectly from the employer and includes any person employed by or through a contractor in or in connection with the work of the establishment.

Membership:

All the employees (including casual, part time, Daily wage contract etc.) other then an excluded employee are required to be enrolled as members of the fund the day, the Act comes into force in such establishment.

Even though employees working on piece rate basis still there PF deduction is mandatory. if their PF will not be deducted then it is a statutory Violence of Principal employer.

So better deduct the PF & ESI amount from there Monthly Bill and deposited on your Company PF & ESI code or have a New PF, ESI Code only for sub contractors and deposited there amount on that code(Preferable).

If more information required you can feel free to discus.

Dear Vikas, your query is not clear. Could you eloborate it.
What type of job was awarded to them?
I understand from your query that they are working with you as consultants or retainers.
If they r long term retainers, your co has to cover them with PF.
What is the Strength of your organisation?
