Dear Mukesh, Giving other allowances and tempting him to work extended hours is not good. It is the right of the security guard to either accept or reject the offer. Minimum input per shift is 8 hrs and maximum OT depends on his commitment and can't be dictated. As Sonlai and Rakesh had rightly mentioned, 'physical fitness' for extended duty plays a major role. Cost cutting is okay but not at the cost of the bank customers' risk. At the height of cost cutting, a bank shouldn't go without a guard for specific time. This concept would attract the trained gangsters to make use of their talents. It is 'Penny wise and pound foolish'. Better to have two for continuos duty. Regards, Chandru

Dear Mukesh, This is the role of HR to advise the management. As most of our friends suggested it is better to restructure the salalries / wages, the duty hours and issue a fresh order to all related employees. Better to restrict all the people to 8hrs atleast upto staff cadre because these cadres only are been covered by all labour laws, by this you are working towards the out put orientation, employee sastisfaction and compliance of statutes. You prepare a document with all pros and cons on the existing system specifically mentioning about the violation of labour laws, employee productivity, business risk and submit to the management and finally it is they to take a call failing which they are responsible for the consequences. Dear Sir, You have not mentioned the location of your bank. However being commercial establishment you will have to abide the provisions of Shops and Establishment Act of the respective state. The working hrs for security guard shall not exceed 8 hrs a day or 48 hrs a week.I also request you to refer the act. Regards Avinash Kanoray

Hi Mukesh, First let me know where is your facility located? Are you located in any Ten districts of Maharashtra where Security Guards Board exists including Mumbai? But basic is that if you are taking a 12hrs. shift from your gunmen, you have to pay 8hrs. as per minimum wages and another 4hrs. as OT which should be ideally double of basic and DA combined. Dear learned friends,
I have few queries considering the above discussion.
1. What is the fallout to the security agency if it's security guard himself has asked that he be deployed only at the establishment/projects wherein he works for 12 hrs and draws the wages accordingly?
2. Is he now, after having voluntarily sought and accepted the said working hours, legally entitled to claim the overtime after a period of , say 5 to 6yrs ?

95/100 companies are not following the rules because this is india. even on salary pasrt also noit following the government rules, where is india now, is this great indian system.

In Bangalore, Karnataka; what are the permissible number of overtime hours a security guard can do? In a firm, the security guards perform 4 hours of overtime every day (12 hours shift; 8 normal hours and 4 overtime hours); 6 days a week. That is around 104 overtime hours per month (26 * 4). They are paid at double billing rate for each of the overtime hours. Is it compliant with law? Can you please provide pointers to the rule around this. The challenge is that the security guards do not want to work for normal 8 hours duty as their salary is almost doubled if they do the 4 hours OT. Their is a shortfall of skilled security professionals and the requirement is not met if the company tried to have 3 shifts.

We have deployed third party security agency but we also want that it should comply to all required statutory compliances as it is required in the social audits done by agencies for foreign buyers.
Kindly guide as to what precautions and documentations are required for security guards deployment.
