Good day !

I am working in a Pvt. Ltd. company since the past 8 months (Joined in April). Due to my MBA entrance exam being held last month, I had taken two weeks leave preparation. I received my October salary before the Diwali holidays.

As per the appointment letter, I am entitled for a maximum of two paid leaves a month after 3 months of probation. As per calculations, I should get 8 paid leaves i.e from July to October.

During my tenure with this company I have taken a total of 13 leaves from July to October (after probation period).

i.e. July - 0 , August - 0.5, September - 1, October - 11.5). By end of October, I have accumulated 6.5 paid leave days.

The pay which I got in October was for 19.5 days where actually I should have got for 26 days (11.5 days leave in October - 6.5 paid leave days). I told the same to the Receptionist who is HR,she tells me that now its too late and it cannot be changed due to PF/ ESI being closed and it will affect the calculations accounts for the remaining months (Is it true ?)

However, she assured me that she will check it. For the last three days, I have been enquiring time and again, but she just keeps postponing it, giving all stupid reasons, (computer is not working).

Kindly guide me as to what should be my next step.

Availing the remaining leaves is the best option for you..there is some wrong with your paid leaves. get it corrected from the hr people. As the esi/pf deduction is already done so there is chance of changing it again. So you can adjust your next leaves manually.

Have a check with your HR person for still how many paid leave are left for now. if you absent for more than 3 days then paid leaves to be considered there. you are paid for 19.5 days and you were absent for total 13 days. As per the date of joining you are eligible for 7-8 paid leave.(it depends on till what date you worked in the month of October before you take leaves). if consider the 8 days of pl for your 13 days of absent then you have to be paid for 21 days. ( you are paid for 19.5 days). The remaining 1.5 days of leave can be utilized on any days in future.
And once the salary is generated and payment is made to pf & esi, there is no chance of changing it again. meanwhile its better to utilize your remaining leaves instead of encashment.
