Hi All,
I have a query regrding resignation date.
1.if we HR team recives EMP resingation and from that onwards his notice period will start?
2.if EMP sends his resingation to his Mgr, then we should consider that day as resignation date and notice period will start from that day?
Pls revert.

Resignation Date : The date reflected in the resignation letter when submitted directly to the manager as hard copy / date in which the employee sends it to the manager or reporting head in mail as soft copy intimating the intention to resign.
This is as per the standard or generally accepted/followed guidelines.
The resignation may reach the HR at a later date after failed negotiation or late acceptance ,which will not be taken to calculate the notice period

Verbal Intimation of the resignation is not generally accepted as a formal intimation to resign.
A written document (Resignation Letter) supporting your verbal claim of resignation should be submitted. The date in which the same is initiated will be the officially recorded resignation date.

Rules are there for every thing, but following it is subject matter. To be specific yes the date resignation letter is received by employer will be date to resignation, and not the date mentioned in the resignation letter.
There are cases were i have faced employee extend his notice period to 2 months.
Basically its upto the employeer and employee relation, depending upon work and urgency we can extend or even reduce the employees notice period.

If an employee is giving intimation notice in writing stating that he/she is getting job in government sector. he/she will be resign if he/she gets the job because in government sector after selection there will be an immediate joining. Now are we liable to release their salary for the said month or not
