Question: An Indian Citizen from India is hired by a listed company for an opportunity based in an other country where he/she has serviced for 4+yrs years on the local country entity payrolls.Post that the associate was transferred by the same company to its India entity office(group company remains the same / name of company is the same). Post playing the role for almost an year in India the associate decides to resign and total experience by the last working day is 5+yrs.The service was continuous across the 5+yrs in the group company and will get relieved in India. In this scenario, will the associate be eligible for gratuity post getting relieved in India, as associate serviced the company continuously for 5+yrs.

If the answer is yes, ways in which associate can claim the benefit incase employer denies gratuity and If answer is No, the reasons please.
