1. SOME of the “Private Security Agencies” are providing Security Supervisors, Security Guards, Gunmen, Ladies Guard WITHOUT the mandatory training and PSARA licence specially heard in and around NCR area i.e, Nodia, Greater Noida, Meerut, Ghaziabad etc.
2. SOME “Private Security Agencies” are NOT paying Minimum Mandatory Wages to the Security Supervisors, Security Guards, Gunmen, Ladies Guard as laid down by the Government of India/State Government.
3. SOME of the “Private Security Agencies” are functioning :-
(a) PSARA. SOME without obtaining PSARA Certificate under the provision of Rule 4, 7 and 12 of “The Private Security Agency (Regulation) Act, 2005”.
(b) GST. SOME may have NOT obtained GST and paying.
(c) Training Certificate. SOME NOT undergoing successfully training and awarded a certificate in Form IV as per Rule 5 (3) of “Private Security Agencies Central Model Rules, 2006” from the training institute or organization to the Security Supervisor, Security Guard, Gunmen and Ladies Guard.
(d) Medical. SOME NOT carrying out Medical as per Rule 6 (3), of “Private Security Agencies Central Model Rules, 2006”, of Security Supervisor, Security Guard, Gunmen and Ladies Guard once in 12 months.
(e) Police Verification. SOME NOT carryout Police Verification report of Security Supervisor, Security Guard, Gunmen and Ladies Guard.
(f) Provident Fund. SOME NOT deducting from the employees and balance paid by the Security Agencies.
(g) Employee State insurance (ESI). SOME NOT deducting from the employees and balance not paid by the Security Agencies which may deprive from the medical facilities.
(h) Bonus. Some NOT giving bonus.
(i) Semi Skill and Skill employees. SOME NOT paying Wages as per the individual qualifications of Semi Skill or Skill employee.
(j) Working Hours. SOME NOT allowing to do duties for only 8 hours or extra hours for which extra wages to be paid. Regular duties are being performed for 12 hours by the Security Supervisor and Security Guards.
4. Section 5 of Code on Wages, 2019 says the “No employer shall pay to any employee wages less than the minimum rate of wages notified by the appropriate Government”. However, SOME of the Security Agencies are NOT paying wages to the Security Supervisors, Security Guards, Gunmen, Ladies Guard etc as per the Minimum Mandatory Wages as specified by the Government from time to time.
5. SOME “Private Security Agencies” have subversion the system which may lead to Security Hazard to human being and also there is exploitation of some of the Security Supervisors, Security Guards, Gunmen, Ladies Guard etc since they are NOT being given their legitimate mandatory wages inspite of they are doing overtime duties.
6. Since their deployment MAY BE IN SOME of the Education Institutes, Multinational Companies, Hospitals, Society, Apartments, Schools, Banks, Malls etc, wherein we are living/doing job/visiting/ children are studying. Citizens togetherness will be a great support to our Government.
7. AS TO HOW WE CAN MAKE OUR SECURITY STRENGTHEN IN THE INTEREST OF SOCIETY AND OUR CHILDREN BY ENSURING THAT THESE “Private Security Agencies” does not subversion the system, thus strictly adhering to the Acts/Rules/Policies of the Government and also there is no exploitation of some of the Security Supervisors, Security Guards, Gunmen, Ladies Guard etc and they get their legitimate wages.
