Dear All, I am facing a problem with PF payment. Instead of paying the challan in the region where my factory is located, I inadvertently paid the amount to a state bank in a different state. Now, the PF office is stating that my company did not remit the monthly PF contribution. Consequently, I am encountering difficulties in transferring the amount. Despite approaching PF officials, I have not received a clear explanation on this issue. Can any one of you assist me with this matter?

Ensuring Correct PF Code for Remittance

You need to check whether the remittance is made with the correct PF code. Each state will allot a separate code to each establishment. If your remittance clearly mentions a different code not belonging to them, they cannot retain the fund; they have to transfer it.

Appealing for Fund Transfer

The Provident Fund Act is a central act. Since the fund is vested with the concerned Regional PF Commissioner, you can appeal to transfer the fund to the respective Regional or Sub-Regional Commissioner. Alternatively, the concerned enforcement commissioner of your area can seek fund transfer as it is an internal transfer. Ultimately, they cannot keep the fund in their books of another region.

There can be delays, and it can accumulate interest too. You need not worry; just be patient and pursue with the higher-ups at the commissioner levels of each region along with the enforcement cells.

Transferring PF Payments Across Regions

I presume the bank's name is partly disclosed and it is SBI. By seeking intervention from higher officials, you may get the amount paid through challan transferred to the region your company belongs to. PF funds are managed at the central level. Please directly appeal to the Regional Commissioner PF of both regions: where the payment was remitted and where you want the funds to be transferred. Include a copy to the enforcement cell of the two regions and follow up. You can produce the documents when the inspector visits. You need not worry about being considered a defaulter.

Clarifying PF Payment Issues

Not a big issue. I assume that you have copies of all the PF Payment Challans, proving that you have made timely payments. The Challan also has the Employer's PF A/C No. mentioned on it. Hence, the amounts paid by you have to go to your PF account. It's a matter of only confirming from the bank where the money is credited. In case the money is credited to the wrong account, it's the bank's responsibility to credit it to the right account. Ask them to correct their mistake.
