I have an issue with my last company MNC that I was asked to leave even achieving after 100% performance. I have also resigned but they did not made the FnF clear in all respect. The variable performance incentive they have not given which is mentioned in the Appointment letter. Apart from the legal suit what to do, whether any govt. department can be brought under notice for this unethical practice with Indian citizens. Please advice....

Dear Colleague,

Kindly approach the employer for all reasonable claim due for you. Escalate to the highest authority of the organization for help and get your dues paid by submitting all your claims with substantial genuine proofs from your side. If no reply then only you may go for legal suit.

If you are a " Workman" under Industrial disputes Act, by nature of your job ( it depends on your nature of service you did and non-managerial and supervisor upto certain wages limit etc), then you may file a claim before the Labour Department for intervention. You may take up your matter with Labour Department for remedy.

If you are a Manager and Supervisory nature of service ( and salary upto to 6500/-pm) then you can resort to Civil Case for breach of Appointment Order as a Civil Brach of Contract and claim for compensation. But before going so legally ( long fight and time/ expenses involved) try to approach employer and amicably try to get your dues paid
