I have been employed in a company for past 8 months in IT. I have signed the appointment letter and offer letter which was in the custody of the employer. I haven't received my copy of the same. Now I have decided to quit my job citing personal problems but my employer sent me a legal notice and forced me to work the notice period of 3 months or will sue me for data theft. What should I do? Note: there isn't a buyout option as well.

Since you unconditionally accepted, you are bound by the notice period in the offer and appointment letter. Your query is silent on the duration of the notice period.
Data theft is entirely different from notice period and it requires concrete evidence to prove the guilt, not so easy a task. It appears to be a threat tactic to force you to pay up.
You need to evaluate the evidence against you. You may consider writing to the authorities mentioning the threat to you and countering it strongly as a counter tactics.

Hello Dear,
Data theft and notice period are two different thing we can't merge Data theft and Notice period together. without any evidence/proof employer can not impose such baseless allegation against you. communicate with your HR for same and put your concern properly. If you have signed you should have to complete notice period accordingly or you can buy. But as you mentioned that there's no option to buy notice period therefore let them know about your problems and discuss for waive off the Notice period.

Hi,

Why you didn't asked for Appointment letter at the time of joining? Make a request to the Employer and ask for copy of your Appointment letter and give them assurance that you will serve notice period as mentioned in the signed Appointment letter.
