It is vertually not possible that the employee has to give 3 months notice and the employer will give one months notice. As per the industrial act 1947 compnaies having more then 500 wokers has to give atleast a minimum of three months notice to the employee before terminating him or 3 months salary in leiu of the notice period. This is also mendatory for compnaies having more then 100 work force. The supreme court of India has also taken it as a cognigence if the company is not complying with industrial act 1947. You can speck to your HR manager for the ractification.

It depends on the employee, whether he would like to be relived earlier. In case yes, then company doesn't have to pay him for early reliving. But if answer is no then company has to pay him his notice pay for early reliving.

I wrote earlier that first of all we have to clear about the terms of employment because it is written in the query that the employee has completed his project in time that's why he submitted his resignation to the employer.
If the terms of the employments contains the completion of the project ( As a Contract with the employee) then no need to pay the Notice.
And if the employee is permanent and having no time contract with the employer that the employer has to pay The NOTICE.
I would like to include one more thing if the employee wants to releive before the complition of the notice period after tendering the resignation then employee is liable to pay the notice.

My notice period was for 90 days. I gave a proper notice of 30 days to give all the handover and since I needed to join another organisation at a time given by the new co. I adjusted my 24 days PL. and for the remaining I was asked to pay the gross salary.
And for the 30 days atleast for a week's time I was not having any work.
But I had to complete my full nine hours and no leaves would be given, except weekly offs.

what i have understood from above is as following:pls correct me if i had misunderstood
Case Resignation:
1.employee need to submit 1 month notice period to company.if no notice period is given by employee side then comapny either can ask for one month pay from his side or can accept the resgination withour asking pay and can relieve him.
Case Termination:
1.company will give 1 month notice period to employee to leave company.if on completion,employee leave no notice pay but if company want to terminate employee with immediate effect then company will give employee the notice pay.

In the terms and conditions agreed by both employer and employee in the time of appointment talk about only termination notice period not about resignation.
employee is going out on his own wish he may be relived as soon he finish his liabilities

An employee holding an important position has submitted his resignation alongwith a cheque in lieu of the notice. He wants immediate release.
We do not want to release him now. Instead how can he give the cheque without the Hr even accepting his letter or stating to him what to pay in lieu of his notice. He has calculated on his own and has given all papers. HR has been asked to return the cheque with a prompt reply but no mention of any release or resignation accepted. Pl. help.
