Hi,

I have a query regarding the applicability of the Shops and Establishments Act. The employer/company is located in State A, and the place of employment of a prospective employee (as mentioned in the offer letter) is State B.

So, based on this situation, which state's Shops and Establishments Act will govern the employee - State A or State B?

Furthermore, to clarify, the company has no branch office in State B where the employee is supposed to work from.

State B where he is employed. I understand he operates from home. He may be just one employee. He will be governed by the state where he is working for legal provisions and raising disputes.

First, check whether your employer is already registered under the respective applicable act. Also, verify if your appointment mentions your place of work. What is your query? ESI, EPF, gratuity, and bonus are all central laws applicable throughout India.
