We are settled in Hyderabad. My wife is working as a nursing in-charge. They collected all the original certificates, including experience certificates. I had not heard about this practice before, as I was abroad before I arrived. She submitted all the originals before my arrival.

Salary Discrepancy Issue

Now, there is a problem regarding the salary they offered. It's the third month, and they are not paying what they promised. They have put her in a trap. Despite her 15+ years of experience, she is now drawing a very low salary. Many good opportunities are arising, but I don't know how to resolve this issue.

Legal Concerns About Document Retention

I have heard that there is a court order about not collecting any original documents to retain. If this is a rule or a violation, please let me know. Many candidates are stuck in this hospital, as they ensure a good salary within three months, which no one receives. Please provide a solution for this.

Issue with Original Documents

Employers keeping original documents is a wrong practice. However, do you have any proof that she submitted them? If not, try to get written proof. If she asks her employer for written acceptance of the document submission, she probably won't get it now. She should have done it prior to submitting. The only way to get proof now is to ask her to write an email to HR and the department head requesting the return of the documents, stating she needs them urgently for personal work. Mention each document she submitted in the email. The email should convey that she is really in need of these documents. It shouldn't be in a rude tone. Once she gets a response, whatever it is, it will serve as proof of acceptance unless they deny having the documents. Once you have the proof, you can request the documents formally, and if necessary, escalate to the labor court.

Issue with Salary

Did the employer promise her in writing that she would be paid a certain amount as salary? Has she received her appointment letter? If yes, what is written in that letter regarding salary or any revisions after a few months? If not, ask her to collect it. An appointment letter clarifies your employment status with an organization. Many employers use tactics to hire talent without putting it in writing, so don't rely on verbal commitments.

Lastly, based on your reply, if the employer is following these wrong practices, it's better to leave them. However, leave on a good note because you never know when you might need their help in the future.
