I resigned from my previous company 45 days ago without serving the notice period. I submitted one month's salary as per my salary slip, but they returned my DD and are now demanding a new DD as per the offer letter. However, I am currently unable to make the payment. Please guide me on how I can claim my Full and Final settlement and my PF amount. I have received the last working month's salary slip but have not yet received the corresponding amount. Please advise on the steps to claim that amount.

Dear Raghvendra, whatever Negi sir told you is absolutely right. If you still want your money, then pay one month (or whatever notice period is decided in the AO) notice pay in lieu of the notice period. Then ask for relieving and other benefits.

I am not able to fully understand your query. If I am correct, you were required to give a 60-day notice (please refer to your offer/appointment letter), but you fell short by 45 days. You have paid one month's salary (equivalent to 30 days), and the company is requesting a new DD for the remaining 45 days. If this is the case, you owe a short notice period of 15 days. If you are unable to make the payment, you can request an extension. Until then, you may not be eligible to claim your relieving and experience certificates.
Please clarify the notice period and the shortfall in the notice period. You can always request the details of your Full and Final settlement calculations. As advised by others, you can claim your PF amount once you have the necessary details.

Dear Govindsinghnegi Ji, Does the notice period represent Gross salary OR Basic + DA? In my Offer letter, it is given as follows:
"Notice Period Details"
"On Confirmation of your services with our organization, two months' notice is required for resigning from the service. Out of these two months, one-month service is compulsorily required, and for the second month, you can opt for one month's salary in lieu of the notice period."
Does the above sentence mean Gross Salary for one month OR Basic + DA for one month? Please clarify, sir.

Dear Sundaravel, it is the gross salary you have to pay in lieu of the notice period. (99.9% of all companies follow the same). If anyone has specified in their AO such a clause of Basic + DA, then they have to give that much only. According to my knowledge and experience, it's always gross. In your case, they have not mentioned anything like basic or DA, so you have to pay the gross salary.
