I need your help with one of my queries, and I would be very thankful for your assistance.
Employment Termination and Allegations
I am an employee in a Limited Company, and my current designation was Senior Account Executive. In August, my company forcefully terminated me based on false allegations of receiving money from vendors upon the release of payment. They pressured me to resign on the same day, but I fought back and made videos showing that they did not allow me to enter the factory, harassed me mentally, and threatened to destroy my career. After a week, I resigned and received an acceptance letter.
Withholding of Full and Final Settlement
Now, the company is withholding my full and final settlement, insisting that I first return the money allegedly paid to me by a vendor. The vendor was also coerced by the company to sign a statement on his letterhead, as his payment of over 40 lakhs is pending release by the company.
Background and Current Situation
I had served the company for over 7 years. The issues began when the company manipulated the books of accounts and pressured me to sign government documents, which I refused. Subsequently, they started recording my activities, tracking where I went, whom I met, and when I entered or left the premises.
Seeking Advice on Next Steps
I am now unsure of what steps to take. Should I approach the income tax department or the labor department? The company continues to threaten me, stating they will not release my full and final settlement. The vendor also informed me that if he does not comply, the company will not clear his dues and apologized over the phone.
I made a significant mistake by resigning due to family pressure. I am entitled to receive my PF, gratuity, bonus, leave encashment, and notice pay.
I am mentally disturbed by the situation. My full and final settlement amounts to approximately 1.90 lakh, and the company is demanding the same amount to be deposited.
