Hi, I have been working with an IT company since January 2021 and am currently on probation for 6 months. I am resigning due to bad management policies and have received a better offer from another company.

When I submitted my resignation, I was asked to serve a notice period of 3 months. The offer letter does not specify a different clause for the notice period during probation.

In such cases:

1. What should I do if they are not agreeing on any other terms?

2. What will happen if I stop working in the organization one month early but hand over all assets in my possession?

3. Will they file any complaints against me that could affect my future career prospects?

4. Is a 3-month notice period legally enforceable during the probation period?

Your employer must have issued you the appointment letter. Please go through the appointment letter; every appointment letter has an exit clause. Please share that clause here for proper advice.
