Please help me with this - Are all the shops and establishment rules also applicable to LLP Organizations? For example, should a 1-month notice period be given if an employee has been in service for the past 3 months? Is this applicable to LLP organizations?

Dear Divya,

The applicability of Statutory compliance and employment laws are defined on basis of criteria mentioned in the respective acts. This has nothing to do with LLP.

The “LLP” word defines the legal registration of the organisation. In other words it is “TYPE OF BUSINESS ENTITY” or in general words “Legal Ownership Status” of the organisation.

The S&E Act is universally applicable to all organisations of the state jurisdiction which falls under the eligibility criteria. (No. of employees). It can be LLP, Partnership, Sole Proprietorship, Pvt Ltd, Ltd, Public Ltd etc……

Hope this will clarify your doubt.

The applicability of all rules of the act may or may not be applicable as per the preconditions of the statute under the shops and establishment.

The Shop and Establishment (S&E) Act is applicable to all commercial establishments. It shall apply to shops and establishments employing ten or more individuals, including business centers, offices, warehouses, stores, hotels, eateries, amusement parks, theatres, etc., nationwide. These establishments may be of proprietary, partnership, company, and LLP.
