I have a question regarding maternity benefits. If I have not completed 12 months of service, will I still be eligible for this benefit? According to the doctor, my confirmed conception date was 24th March 2020. Until that date, I had not completed 80 days. Will I still qualify for maternity benefits?

Thank you.

In India, maternity benefits are governed by the Maternity Benefit Act, 1961. According to the Act, to be eligible for maternity benefits, an employee must have worked for a minimum of 80 days in the 12 months immediately preceding the expected date of delivery.

Given your situation where you have not completed 80 days by the confirmed conception date of 24th March 2020, you may face challenges in qualifying for maternity benefits as per the legal requirements. However, it is advisable to consult with your HR department or legal counsel to understand if any exceptions or provisions apply in your specific case.

To ensure you have the most accurate information and guidance, it is recommended to seek clarification from your employer or the relevant authorities regarding your eligibility for maternity benefits based on the specific circumstances of your employment tenure.
