Hi Seniors,
I want to know whether, Applicability of Maternity benefits to a women employee is relavent to her service in the organization? Suppose, if the woman has recently joined 3 months back and is under probation, whether she would be applicable to get the maternity benefits?
Also plz let me know, for a woman employee not covered under ESI, maternity leave encashment has to be given on basic salary or gross salary?

Under the Maternity Benefit Act, a minimum 160 days of work during 12 months preceding the EXPECTED DATE OF DELIVERY is required. Therefore, a probationer can avail it provided before the date of delivery she completes 160 days of work.
The benefit of 12 weeks leave with pay means salary which includes DA also.

A woman employee is eligible for maternity benefits under the Maternity Benefits Act if she had worked for not less than 160 days in the 12 months immediately preceding the date of delivery. Therefore, a new comer will get time upto the date of delivery to recon back the days worked. If she satisfies 160 days work before the date of delivery she will be eligible for benefit @ 12 weeks leave with pay. The wages for this means Basic + DA
