Apply and obtain permission from the proper authority which registered the premises - from the Factory Inspectorate in case the premises is a factory (industrial establishment) or a commercial establishment in case the premises fall under the jurisdiction of Shops and Establishments. For premises other than the said two, check with the notified authority for establishments/institutions like educational, entertainment, hospital, etc.

In this scenario, my primary advice is that you cannot lease out a portion of the premises that fall under your factory's ownership. In other words, another party cannot operate a business within your factory premises, even if it is vacant land or a building. This restriction is due to the entire compound being covered by the factory license issued to you. Therefore, you are not permitted to sublet any part of it to another entity for a separate business operation. If such a business is conducted, you will be considered the occupier of that operation and will be required to include their employees under your ESI/PF codes. Additionally, you will bear responsibility for any incidents involving the workers on the premises.
If you construct a compound wall to separate the building, you can resolve this issue. However, to do so, you must update the factory layout, drawings, etc., submitted to the Inspector of Factories and Boilers. Take the necessary steps to address this matter.
