I have a doubt regarding ESI and Employee Compensation Act applicability to my establishment. ESI is applicable to my company as it falls under an ESI-covered area, and we have employees whose salary is less than Rs. 21,000.

Accident Compensation for Employees Not Covered Under ESI

1. What if an unwanted accident takes place at the site? Employees covered under ESI will be compensated through ESI, but what about employees not covered under ESI (earning more than Rs. 21,000)?

Employee Compensation Act for Higher Earning Employees

2. Can we take ECA for employees earning more than Rs. 21,000 so that they are compensated in case of any unwanted incident at the site?

Dual Coverage Under ESI and ECA

3. Can an employee be covered under both ESI and ECA? As per my knowledge, ECA applicability ceases when an establishment is covered under ESI.
