Hello, the current employer won't accept my resignation even though he is about to shut down his business on March 31, 2018. I have received an opportunity with another company. My employer insists that I serve a 30-day notice period, which is not feasible for me as my joining date is on Feb 21, 2018.

Firstly, he claims that it was previously communicated to us that everyone would be required to serve a 30-day notice period. He also encouraged us to begin looking for new job opportunities.

Secondly, he mentions that he is attempting to help all employees secure new jobs. I have received a call from a company where he forwarded my resume, but they stated they are unable to match the salary package.

I am willing to serve a notice period of 19 days, adjust my leaves, and buy out the remaining days. However, he is unwilling to agree to this compromise.

What should I do now? I am from India.

Dealing with a Stubborn Employer

This employer, although he appears to be helping his employees, seems to be a difficult person to deal with. You may just have to endure his behavior. It might be better to try convincing the prospective employer to allow you to join only after actually serving the notice period as insisted upon by the current employer. The exact reason for his insistence is unclear—whether it is due to his stubborn nature or because the pre-closure operations genuinely require your service. If the mountain will not come to Mohammed, then Mohammed has to go to the mountain—that's all!

I contacted the new employer and informed him about the situation but he denied changing the joining date. Any other inputs? Please help me resolve this.

Deciding on the Appropriate Course of Action

Now you have to decide on the course of action that is situationally appropriate. Your current employer is going to shut down their business on 31-03-2018. However, they insist on your service until the last date, even though you are willing to buy out the remaining part of your notice period to have a formal and peaceful relief in order to join the new employer on the specified date. Your request to join after 31-03-2018 has been categorically turned down by the prospective employer. If you try to satisfy both parties, in any way, you will have no job beyond 31-03-2018. Therefore, decide accordingly.
