Preparing a Leave Policy for a Pathology Business

I have to prepare a leave policy for my company. We are in the pathology business, and the head office is based in Ahmedabad. I want to confirm the following:

- Which Act will be applicable for policy rules?
- How should we go about giving leaves to employees working in different regions, such as Delhi?
- Can we introduce something to promote leave encashment on a month-to-month basis? The reason is that, as a pathology industry, we need people in the workplace 24/7 since it has a direct impact on our business.

Gujarat Shops and Establishment Rules for Leave

As your business is a kind of shop/commercial establishment, you have to follow the Gujarat Shops and Establishment Rules for leave rules.

The Gujarat Shops and Establishment Act 1948, earlier called the Bombay Shops and Establishment Act 1948, covers aspects such as Earned Leave/Privilege Leave and Maternity Leaves. However, there is no specific mention of Casual Leave and Sick Leave. As ESI (Employee State Insurance) is applicable, Sick Leave could be availed under ESI leave.

Delhi Shops & Establishments Act 1954

If you have a branch in Delhi, as per the rules, you have to get registered under the Delhi Shops & Establishments Act 1954, and the leave rules shall comply with it.

Leave Encashment Policy

Leave encashment is a matter of company policy, and it is up to you to decide whether encashment can be done on a monthly basis or annually. While considering 24x7 people allocation as the first priority, ensure that the process is also simple and manageable.
