I left my previous organization without serving the complete notice period of one month. As per my offer letter, the terms and conditions for the termination of service were:

Services may be terminated by either party by giving a 30-day notice period in writing or by giving one month's salary.

After my confirmation in the same company, as per the appointment letter, the termination conditions were:

Reason for Quitting the Job

1. During my probation tenure, I was entitled to Rs. 30,000 (in hand) as remuneration. The same was paid to me in cash. On objecting to the salary in cash, the management turned a deaf ear and stated that it is our company's policy to pay cash during probation.

2. After becoming permanent, my salary was reduced to Rs. 25,000. Upon asking for the breakup, they showed deductions in:
- Bonus at 8.33%
- Leaves granted to employees in a year
- Professional tax
On objecting to such deductions, they stated "either take it or leave it."

3. Despite being a postgraduate, they made me do all clerical jobs, for which I had complained twice to the seniors.

4. Upon submitting my resignation in the first week of December to the partner of the company, he refused to accept it. Subsequently, the company stopped paying my November salary. They finally released my November salary after a 6-day delay from the usual payment date.

5. Post my resignation letter, I faced mental harassment from the partner of the firm.

I served the company for the month of December for 13 days. With increasing torture and harassment, I decided to quit the company immediately after informing one of the partners of the firm.

After a few days, I received a Registered Ad stating that I must pay for the remaining notice period and a significant amount towards harassment caused, or else they will initiate criminal and civil action against me.

My Query

1. How can I work with a company that is mentally torturing me?
2. I was not paid my November salary after my resignation, and they made me plead for it.
3. Nowhere in my employment contract is it mentioned that I shall be prosecuted under civil or criminal actions for any breach. Can they do so?
4. Are there any judgments by the high court where an employee can terminate a contract if they are mentally tortured or pressurized? If yes, can you please provide information on those important judgments in favor of my case?
