I am a confirmed staff member working as a Regional Manager. One fine morning, HR called me and asked for my resignation, stating that I am spreading bad humor against the company. However, he couldn't specify what the actual issue was, and I am certain he is talking nonsense. Today, he is claiming that I am not meeting the expected sales targets and that I am not achieving the set goals, so I have to submit my resignation.

When he inquired about my targets, I clearly explained that since it is a newly formed division, my boss has not yet provided me with any official targets. It is my responsibility to appoint super stockists and distributors to establish the foundation. This is the reality as we do not have any existing setup in the East. My boss tasked me with setting up the infrastructure, and from last August until now, I have successfully appointed five super stockists and distributors.

Now, they have placed my salary on hold and are pressuring me to resign. When I tried to contact my boss, he did not answer my calls. What should I do? Should I resign voluntarily, or should I wait for them to terminate me? What would be the best course of action for me to take next?

One more thing I want to add: in my notice period, I have a 3-month notice period on either side. However, they are not giving me any time to serve my notice period. They are clearly stating that I will not be paid for these 3 months.

If your target is not met, HR should not ask you to resign. If the company considers you a non-productive employee, HR must issue two warning letters to you within a week to improve your performance. If there is no improvement, they will terminate your employment, providing one month’s notice. They are not authorized to accept your resignation.

Sir, first of all, I don't have any official mail from the target as the distribution network is not present at the moment. I had single-handedly managed 5 super stockiest. Therefore, there was no proper communication about the targets.

There was no clause of termination as they can transfer me to any other division or place, but there was nothing in writing about termination. Suppose the HR sends me the termination letter, what should be my next step?

Hi,

Find out where you can file a Right to Information (RTI) and proceed accordingly. I am not certain if you need to do this through the labor court. However, only take this step if you are confident that you are in the right and not at fault. I am mentioning this because we have only heard your side of the story and believe it to be true.

At last, HR requested me to put my resignation on paper. According to him, he knows everything, and I am not receiving justice. He still has to do his job; otherwise, he would be in trouble. When I requested a letter detailing the faults he found in me, he was speechless and shared all these concerns. Upon expressing my inability to comply, he mentioned transferring me to another region. However, he also acknowledged that he would face consequences from the management if he failed to obtain a resignation letter from me. Being a family man, he constantly urged me to submit the resignation. Eventually, I submitted it, even though I had a three-month notice period and requested only one month. To date, they have not acknowledged the submission. What should I do? Please guide me.
