If an employee works for two companies, and in one company, they work an 8-hour shift earning more than 15000 INR per month, they are not eligible for ESI. However, if they work for another company part-time and earn a salary of 8000 INR per month, they are eligible for ESI.

The law in India relating to factories very clearly specifies that dual employment and double shift working are not permitted. A person can work for two companies part-time, but not if one of them is full-time.

So, the rest of the question is probably moot.
