Navigating Unpaid Salaries and Final Settlement Disputes: Legal Remedies and Steps - CiteHR

No Tags Found!

I used to work for a real estate company in India, Mumbai, and left on 10/06/2015. However, they have not yet paid my May and June salaries. It was said that I would get paid in full during the final settlement within a month, but it has not happened yet. I have the salary slip for May from them, but the payment has not been made to me. Additionally, I have officially resigned with the proper resignation and notice period.

Seeking Advice on Unpaid Salaries

Please suggest what should be done in such a scenario. I am trying to reach out to everyone possible in the company, including the director, but have not received any response yet. Kindly suggest a legal way to claim my salary.

When you have served the notice period and received relief, you will certainly get the final payment settled. In case the organization fails to do so, it is advisable to get in touch with the EPF authorities for your PF settlement. Furthermore, if you have served for more than 10 years, you will receive a pension certificate accordingly.

Steps to Ensure Final Payment Settlement

For other settlements, start by serving a notice to the organization in writing and wait for 15 days to receive a reply. After 15 days, send a copy to the nearby labor office and wait for another 15 days. Then, you have every right to proceed against the organization for non-settlement. Always ensure you give the organization time to respond.

Check Company Registration

Check if your company is registered and under which category. Find out and approach the relevant authorities.

Best of luck...
