Subject: Claim for Settlement of Monthly Pension (as per EPS Act 1995)

Claim for settlement of monthly pension against Form 10.D submitted to M/s BGR Energy Systems Ltd, based on my eligibility for receipt of monthly pension since 12/10/2012 (i.e., upon attaining the age of 58 years on 11/10/2012). This claim is due to absolute and uninterrupted continuity of service for nearly 17 years as a contributor to the EPS account through three different employers, effective from 16/11/1995.

Employment and Contribution Particulars in Chronological Order

- M/s Simplex Infrastructures Ltd: Worked during the period 31/03/1995 to 09/04/2006 (i.e., 10 years, 03 months, and 25 days) with PF Account No: WB/CA/29601/P1842 and employee code no: 5107.

- M/s HCC Ltd: Worked during the period 15/04/2006 to 24/11/2008 (i.e., 02 years, 06 months, and 40 days) with PF No: MH/BAN/22800/7072/R843 and employee code no: 6241.

- M/s BGR Energy Systems Ltd: Worked during the period 01/12/2008 to 11/10/2012 (i.e., 03 years, 10 months, and 11 days) with PF No: AP/GR/CDP/19918/3098 and employee code no: 3539.

Upon attaining 58 years of age on 11/10/2012, I ceased employment with M/s BGR Energy Systems Ltd. It is confirmed that I received a full refund of Provident Fund accumulations. However, my Form 10 D, i.e., application for approval of pension payment, duly forwarded by M/s BGR Energy Systems Ltd, was rejected by the office of the APFC, Cudappa under Gundur Division of PF, for want of backup particulars of service and EPF contributions from two of my previous employers, namely (1) M/s Simplex Infrastructures Ltd and (2) M/s HCC Ltd, prior to my joining M/s BGR Energy Systems Ltd.

Although I submitted statutory formats like Form 13 and Form 10 C EPS for the transfer of FPF amounts from my employers, M/s Simplex Infrastructures Ltd and M/s HCC Ltd, they are taking an unduly long time to respond to my requests despite my efforts through letters, phone calls, and emails. They are neither providing the scheme certificate nor effectively transferring my EPF contributions to merge with those of M/s BGR Energy Systems Ltd. M/s HCC Ltd assures me they are trying their best to facilitate the virtual transfer of my FPF accumulations, but this is not happening. Similarly, M/s Simplex Infrastructures Ltd assures me they will provide the scheme certificate to make me eligible for applying for a monthly pension. Both companies are delaying the issue of the scheme certificate and/or the virtual transfer of FPF accumulations with M/s BGR Energy Systems Ltd.

Accordingly, I understand that M/s BGR Energy Systems Ltd is unable to process my Form 10 D for onward submission to APFC, Cudappa due to a lack of proper feedback from the two previous employers with whom I worked before joining M/s BGR Energy Systems Ltd.

Now, in this context, I have taken up the matter with the Consumer Services Division of EPFO, Delhi. They have given me a grievance registration number as “CEPFO/P2015/04868” on 3rd June 2015. Upon my telephonic follow-up, they advised me to wait 30 calendar days from the date of registration, i.e., 3rd June of this year.

PLEASE STUDY THE DETAILS GIVEN ABOVE AND ADVISE ME ON WHAT TO DO TO EXPEDITE MY CLAIM FOR GETTING A MONTHLY PENSION.

Submission of Form 13 and Scheme Certificate Requirements

Where did you submit Form 13 through M/s BGR Energy Systems Ltd as it was supposed to be submitted? The concerned Sub Regional PF Office had to collect the details from previous offices after the submission of Form 13. There is no need for Form 10-C, i.e., for a scheme certificate, after submitting Form 13. Also, for the scheme certificate, Form 10C should be submitted to previous offices through previous employers. In other words, you cannot submit both forms to a single employer in this case.

For scheme certificates of previous services, fill out Form 10C, obtain endorsement from concerned employers, and submit it to the concerned Sub Regional Offices.

Dear Mr. Abbas, I had submitted the hard copy of Form 13 in respect of both (1) M/s HCC Ltd and (2) M/s Simplex Infrastructures Ltd to my very last employer, i.e., M/s BGR Energy Systems Ltd. The submission of Form 13 was also advised by a nodal officer from Cuddapah EPFO under the concerned SRO of Guntur, AP. However, M/s BGR Energy Systems, being a registered member under the online transfer portal, was not ready to process my hard copy applications.

I then attempted an online transfer of EPF (pension portion) by logging in to the portal through the UAN number allotted to me by EPFO. It came to my attention that both M/s HCC Ltd and M/s Simplex Infrastructures Ltd have not registered as members on the online transfer portal and therefore cannot be considered eligible for online transfers. This contrasts with the stance taken by M/s BGR Energy Systems, who updated their records and went online by registering with EPFO, holding their UAN and thus refused to proceed with my hard copy application of Form 13.
