My company's notice period is one month. I resigned on the 12th of August, and my last working day was the 30th of August instead of the 11th of September. Could you please guide me on how my salary will be calculated? Will it be from the 1st of August or from the 12th of August?

As per my understanding, your salary will be calculated from the 1st based on attendance, but the notice period will be considered for 30 days from your date of resignation. During the notice period, if you serve for 15 days, the remaining 15 days' salary will be recovered against the notice period.

My sincere suggestion is that you should follow the appointment terms and conditions of your company.

Rightly said by Murali, since you haven't served the complete notice period according to the company's terms, you would be eligible for a deduction of pending notice period days. For example, in your case, you would be paid salary between the 11th of August and the 31st of August, and 10 days of basic salary would be deducted from your earnings.

The terms of employment state that either side must serve one month's notice or pay one month's compensation in lieu of the notice period. If this is the case, you resigned from the services of the company on 12th August by serving a 19-day notice period because your last working day was the 30th. The shortfall of the notice period is only 11 days. Therefore, you are required to calculate your 11 days' salary and pay compensation accordingly by cheque.

Actually speaking, this is an illegal deduction. If it is agreed upon in the terms of appointment that you will deposit or surrender the notice pay amount, then only such deduction is legal; otherwise, it is an illegal deduction as per the provisions of the Minimum Wages Act.
