I have joined a new organization as an HR Executive, and the organization is currently in the process of merging with an MNC. I would like to know whether the company name should be changed to the new company name or if we should close down the previous employer's PF & ESI accounts and apply for new registrations. Kindly clarify this.

You have to fill out Form-5A (Return of Ownership) along with the application and supporting documents for a name change, such as a copy of a bank account statement, electricity bill, or any supporting document of the name change.

Procedure Under ESI for Merging Companies
So far as the procedure under ESI is concerned, kindly refer to Section 93A of the ESI Act, 1948. When existing firms or companies are closed or merged, please inform the appropriate Regional/Sub-Regional/Divisional, as well as Branch Office and Inspection Office of ESIC.
If the employees are taken over by a company that already has an ESI Code Number, compliance for all such insured persons can be carried out using the code number of the firm with which the companies are merged.
The matter can also be discussed in person with the appropriate authorities of ESIC, as mentioned above.
