Hello Everyone, I am Seema. I have worked as an off-roll employee in my current organization for 3 months. After that, I continued my job as an on-roll employee. However, to date, I am facing problems with my PF withdrawal for the off-roll period of 3 months. My employers are saying that I am not eligible to withdraw it since I worked only for 3 months as an off-roll employee. I can only withdraw my 3 months PF if I have worked more than 3 months in the organization.

Guidance Required for PF Withdrawal

Please guide me on what I can do to withdraw my 3 months PF amount.

yes you will be getting the pf contribution only,pension amount will be given if you contribute to 6 months only.ok seema u eligible to pf claim . from: jignesh vasava

You cannot withdraw your EPF (&EPS) because you are still in the same establishment, and there is no definition of off-roll employee and on-roll employee. So if the establishment is the same, then the EPF number given to you would also be the same as before. If they are saying that you are not eligible for EPF, then they are talking nonsense.

I have one more question as I have been working in the same organization for the past 3 years on company payroll. However, for the initial 3 months, I worked on a third-party roll for the same current organization. Am I eligible to withdraw my PF now? Also, why am I unable to withdraw any pension, and what about the employer contribution for the same?

Let's suppose my basic salary is 12 thousand per month. How much amount will I receive for PF withdrawal for the 3-month duration? Kindly assist me with this.

ur 12000/- basic salary 12%+ differance pf-pension= ur total pf fund in ur pf fund = 4320/-+2697/-= 7017/- in ur pension fund = 1623 /-

EPF (& EPS) Deduction Less Than 6 Months

Seema, the amount of EPF will be refunded to you, and EPS will be forfeited. So, do not try to withdraw when your service is less than 6 months.

EPF is 12% from the employee + 3.67% from the employer. EPS is 8.33% from the employer only. Now, if the salary is Rs. 12,000, then EPF 12% = 1,440 + 3.67% = 440 + 459 = 2,339 (459 from EPS share, the reason being EPS has a ceiling of Rs. 6,500, i.e., 6,500 * 8.33% = Rs. 541) & EPS 8.33% = 541 (the excess amount is adjusted in EPF 3.67% share).

To your question about the amount of EPF for 3 months: 2,339 * 3 = 7,017 & EPS 541 * 3 = 1,623.

Note

In everything above, if the employer implemented a ceiling of Rs. 6,500 (basic), then even though you are getting a basic Rs. 12,000, the employer is not bound to pay EPF up to Rs. 12,000. He can restrict his share to Rs. 6,500, i.e., 6,500 * 12% = 780 not 12,000 * 12% = 1,440.

As per PF rules, if an employee's service is less than six months, then he/she can withdraw only the EPF share, and the FPF amount cannot be withdrawn. The FPF amount can be transferred to your PF account.

EPF Withdrawal Process and Employer Issues

I agree with jcvasava that EPF accumulation can be withdrawn by simply filling out Form 19 and getting it attested by the employer. If the employer is not willing to sign the form, you can get it attested by your bank manager or a gazetted officer. Submit the form to the concerned EPFO along with a letter complaining about the employer not signing the EPF withdrawal claim. EPFO will promptly address your complaint by sending someone from their team to facilitate the employer's signature. To access EPS accumulation, a minimum service/contribution of 180 days is mandatory.
