This is in reference to the Minimum Wage (MW) as per different state notifications. Do we need to consider the gross salary, ensuring it is not less than the MW, or should we focus on the basic salary being not less than the MW?

Minimum wages are a component of basic + DA, so how should the basic salary be bifurcated into another basic? Bifurcation of minimum wages is strictly prohibited.

Thanks, Sumit, for your response. It is surprising and annoying to find such queries so often. I wonder why companies—which are incorporated legal entities—cannot think beyond the minimum wages prescribed by the law. Moreover, they think and plan to break up these wages to rob the poorest of labor and to reduce their statutory obligations prescribed under the law. Are they happy to achieve minimum profit? Would they be happy if employees perform minimum work? Would they hire people with minimum qualifications? Would they be happy if they are called the lowest among companies?
