We are an authorized service center providing services to the customers of LG Electronics India Limited for their Mobile Phones. The contract is renewable every year by LGEIL.

A labor officer visited our office and issued a notice for non-registration of our service center under the Uttar Pradesh Shop & Establishment Act. He also requested the salary register, attendance register, etc., for inspection and asked us to deposit Rs.250/- in the treasury and visit his office.

To the best of my knowledge, we are not required to register under the said act, as we have only 4 persons earning more than Rs. 4000/- per month. Moreover, we are working on behalf of LGEIL.

Please guide us.

Hi,

The Shops & Commercial Establishment Act applies to every establishment and shop where any kind of commercial activity is going on. You need to register with the Shops and Commercial Department by filling form 'L' and depositing a fee. Please refer below:

1. With no employees: Rs. 40.00
2. Between 1 and up to employees: Rs. 200.00
3. Between 6 and 10 employees: Rs. 300.00

Also, you need to maintain the prescribed register under this Act in the form of Form 'CC' for keeping records such as attendance, wages, and leaves.
