I m on leave & not getting salary for 2 months, should i liable to pay professional tax for those months

need to pay anything if your not earning.... like esic, pf, tds, Professional tax also. do let me know for more information on the same.

Thanks for your reply. No, I'm not receiving benefits like ESIC, PF, or TDS in my current service. I have been on leave for 2 months, but now the employer is saying that I have to pay two months' professional tax in the current month.

Hi, Ask him where the rule is mentioned as Professional Tax. I do not thinks we should pay, any way here i am attaching the act please go through it.

Dear, If your are not earning anything.. then how shoul you pay PT for the same.. If you are earning Zero for 2 month then you dont have to paid PT over there... Kamlesh

Dear.. PT is calculated on the particular month’s salary u take. If u are taking Zero, how will u calculate the PT. Ask your HR the same. Best Regards Harish Nayak

If you are not being paid for an entire month, then you are not liable to pay Professional Tax under State Law on Professional Tax as amended from time to time by the state government.

If your are leave & your are not paid for that mean if your leave is without pay that there is no need to pay Professional Tax

Employer used to diduct from salary every month if, employer is not paying salary so can not deduct Professional tax for that month.

Any deduction from salary is done from gross earnings. Professional Tax is a deduction from your gross earnings. It seems you are from Mumbai.

Professional Tax in Maharashtra

In Maharashtra, you are liable to pay Professional Tax as follows:
- Nil if your gross earnings are up to Rs. 5000/- per month.
- Rs. 175/- if your gross earnings are from Rs. 5001 to Rs. 10000/-.
- Rs. 200/- (or Rs. 300/- in February) if your gross earnings are Rs. 10001/- and above.

no work no pay hence no tax explain same to your director/hr/a/cs dept else send your query directly to labour dept.for action to be taken

Dear Deepali Ji, as my friends suggested, you need not pay any PT for those two months as you have not earned anything. Even if you earn and if it is below Rs. 10,000, you need not pay anything. Ask your employer to go through the Act and come out with a clear picture on the deductions.

what if i have earned 9000/- for 28 days and my salary is 10000/-,what amt of PT should I pay. Is it 175/- or 200/-. i short PT is Calculated on Take home salary or on the Fixed Salary
