Navigating Revised Compensation and Employee Consent in an Indian MNC: Legal Insights and HR Conside - CiteHR

No Tags Found!

I am working in an Indian MNC in sales. My employer sent me an email regarding revised compensation, reducing 15% of my total compensation. The basic salary has also been reduced by the same percentage. The email was sent to me just 3 days before the revised salary was credited to my account. I was not communicated with earlier, and no consent of mine was taken. Moreover, the policy has not been implemented uniformly for many other colleagues of mine who were lesser performers than me. Kindly advise on what legal action can be initiated.

Thanks and regards,

Special Resolution Requirement for Salary Reduction

A company needs to form a special resolution for this kind of action. They must obtain the consent of the employee whose salary is going to be decreased beforehand. Otherwise, it is considered an unfair practice under the employment conditions of sales staff. You can consult with your HR department for more justifications before proceeding with legal action, which could affect your job existence.

It is rather unfortunate that your salary has been revised downwards. However, you have no legal action to be taken against your employer. You can approach your boss to explain why you have been treated that way. You admit that you are a low performer, which is why you have little to do. Your worry is that other lesser employees are earning higher salaries than you. You believe they are lesser performers, but in the eyes of management, they are considered better performers than you. What about that?
