Respected Sir,

My name is Pragnesh. According to PF Law, we are required to submit the Paid PF Challan by the 15th of every month. We should submit Form No. 5, 10, and PF Form No. 12 A at the PF Office. However, in my organization, they are not submitting any month's paid challan, Form 5, 10, 12 A, or even Form 9.

I have recently joined this organization, and they are asking me to complete all these formalities. I do not have any experience with these types of procedures, so I am feeling quite anxious. I kindly request your valuable advice on how to complete all these procedures and how to interact with the PF Officer.

Please provide me with proper guidance to resolve this issue.

Not to worry. First of all, please let me know for how many months/years the same issue has been pending. Secondly, I hope you have all the challans for the pending period. Finally, up to which month is Book 9 updated?

Don't worry, soon you will become an expert in statutory compliance. Since you are going to create the data for the organization from scratch, first understand the basics of all forms required for the PF/ESI monthly/half/annual returns.

Understanding PF and ESI Codes

Next, does your company have a PF code/ESI Code? If not, apply for it. From the date when your organization's employee strength is above 20, create Form 5, Form 10, monthly challan, and 12 A for every month. If you have to do this for years together, then prepare Form 3A and 6A for the respective years. For ESI, prepare monthly challan and half-year returns.

Filing Returns and Seeking Assistance

After that, you can apply for ESI/PF returns. It's better to seek help from a PF/ESI consultant if you haven't filed returns for years. Inform your organization that you may have to pay penalties/damages for the delay, which may vary from 17% to 35% annually for both ESI and PF.

My advice is, don't worry about the past, and start all compliance from your period and keep the records updated.

PF Compliance Deadlines

The PF challan's last date of payment is the 15th. Form 12 A, along with Form 5 and 10, has a last date of submission on the 25th.

Form 9 Submission

Form 9 is required at the starting time of the establishment and only once. You may ask the PF office if they will accept it later, and you may send it then.

Pending Challan Payments

Dear Sir, We have four different properties (Gujarat, Rajasthan, Chennai, Bangalore). When all four challans are gathered, one month is completed. Currently, almost six months' challan payments are pending. I have no idea about Book No. 9.
