As per the provisions of the PF Rules, if the permanent strength (salary being paid regularly) of employees is more than 20, the organization needs to provide a PF facility. To apply for the same, please approach the local EPF office, collect relevant forms, and submit the filled-in application. It is not very cumbersome, and records that are needed are: P&L account, salary register(s), attendance register(s), extract of bank accounts, memorandum of association, etc. There are many consultants who can get this done for you by collecting a fee. The EPF organization may choose to visit your premises and demand to inspect all old records, so be ready for the same. Though you can restructure the CTC to accommodate the PF recovery, initially there will be a drop in take-home pay of employees, which will become a reason for resistance from them.

The P.F. Act is applicable to a factory specified in Schedule I appended to the Act, employing twenty or more employees, who need not only be permanent but also include contract labor. So, first ascertain whether your establishment is a factory covered under Schedule I. An establishment other than a factory can be covered by a notification issued by the Central Government. This needs to be confirmed first by you, provided it employs twenty or more employees.

You have to apply for the company through the concerned P.F. Enforcement Officer in your area. Normally, he will be stationed at the District Headquarters. He will provide the application for coverage of P.F. and guide you in this regard.

Either you can obtain a sub-code number for the contractors, or you can deduct the E.P.F. contribution from the contractor's bill and ensure that it is paid (legally permitted under the Act). In either case, the principal liability to clear the E.P.F. arrears lies with your company. Another option is that if the contractor has 20 or more employees, he can be instructed to obtain an independent E.P.F. Code No. so that the liability will be on his shoulders.
